First infringement procedure related to EETS Directive completed by EU Court
The European Commission has initiated several infringement procedures against Member States for incomplete or wrong transposition of the EETS Directive (EU) 2019/520. Where no satisfactory resolution is achieved, such cases are referred to the Court of Justice of the European Union. On 30 April 2026 the first case related to the EETS Directive was concluded. In case C-479/23, Commission v Bulgaria, the Court found that Bulgaria failed to adopt and notify the necessary national measures to fully implement the EETS Directive on the interoperability of electronic road toll system by the deadline of 19 October 2021.
Despite some legislative progress during the proceedings, the transposition remained incomplete for several years.
Given the duration and seriousness of the infringement, the Court ordered Bulgaria to pay a lump sum of €1.9 million to the European Commission.
Directive (EU) 2019/520 aims to ensure the interoperability of electronic toll systems across Europe and to facilitate the cross-border enforcement of unpaid road fees. The ruling highlights the importance of timely and complete implementation of EU legislation in this area.
